Updated On 16 Aug, 2018 Published On

Jennifer Garner would have to refile for divorce from her estranged husband Ben Affleck. Yes, you read that right. The Alias star is giving the Justice League star another chance to ‘Work on His Health’.

According to new court documents obtained, the estranged couple, who announced their split in June 2015, were warned by an L.A. Superior Court judge that if they can’t settle their case, he would call it off.

The 46-year-old actress has been stalling since filing in April 2017.

Of the actor, who has struggled with addiction to alcohol, a source says, "Jen wanted to give Ben the time and opportunity to work on his health and sobriety. She isn’t in a rush.”

And she is doing this because of the duo's three children: Violet, 12, Seraphina, 9, and Samuel, 6. The insider says Jennifer wants him to “be the best father he can be. She wants what’s best for the kids.”

Ben, however, has already moved on with a new girlfriend; he is dating Saturday Night Live producer Lindsay Shookus, 38.

The source continues, "Ben would have liked to have finished this and closed the books sooner" but “Jen just isn’t willing to settle the custody issues until she’s 100 percent certain that he’s clean."

Ben seems to be already rising up to the task. On August 13, he was spotted attending an Alcoholics Anonymous meeting.

A source revealed at the time,

This is part of his practice and how he maintains his personal health. He’s been doing these classes for months. He’s also been spotted outside of meditation classes as well as meetings. He’s focused on being there for those in his life.
